Terms of Service

1. About MoveIn
MoveIn is an online rental marketplace serving the Republic of Ireland. The Service is operated by Noveternum Limited, a private company limited by shares incorporated in Ireland (CRO Number: 741598; registered office: Hill View Retreat, Athlone, Co. Westmeath, Ireland). References to "MoveIn", "we", "us" and "our" are references to Noveternum Limited.

2. Acceptance and Eligibility
By creating an account or otherwise using MoveIn, you agree to be bound by these Terms and by our Privacy Policy, which together form your contract with Noveternum Limited.
To use MoveIn you must:
- Be at least 18 years old.
- Have the legal capacity to enter into a binding contract under Irish law.
- Not be prohibited from using the Service under applicable laws, including sanctions regimes.
- Hold only one account at a time. Accounts are personal — you may not share login credentials.
- Provide accurate information about yourself when registering and keep it up to date.
You are responsible for keeping your login credentials confidential. Notify us immediately via our contact form if you suspect unauthorised access.
3. The MoveIn Service
MoveIn provides an online platform that allows landlords and their agents ("Landlords") to list rental properties and that allows prospective tenants ("Renters") to search, save, and inquire about those properties. We also provide market price information (the "Price Score"), saved-search alerts, in-platform messaging, and related features.
MoveIn is not a party to the rental contract. Any tenancy agreement, deposit, viewing arrangement, or other commitment is between the Landlord and the Renter directly. MoveIn does not:
- Act as an estate agent, letting agent, or auctioneer.
- Provide financial, legal, tax, investment, or property advice.
- Independently verify every listing, Landlord, or Renter beyond the targeted checks described in these Terms (e.g. landlord phone verification, scam detection, flag review).
- Hold deposits or process payments between Landlords and Renters.
The Price Score is informational and is computed from aggregated market data (including data published by the Residential Tenancies Board). It is not a valuation, appraisal, or recommendation. You should make your own enquiries before relying on it.
4. Listing a Property (Landlords)
By listing a property on MoveIn you confirm that:
- You are the owner of the property or have the express authority of the owner to let it on the terms advertised.
- The listing is accurate in every material respect — particularly bedrooms, bathrooms, location, rent, deposit, availability date, and any restrictions (e.g. pets, smoking).
- Photographs depict the actual property and were taken by you or used with the rights-holder's permission.
- The property is genuinely available to let at the price and terms shown, and you will mark it "Let agreed" or remove it promptly once it is no longer available.
- You will register any tenancy resulting from a MoveIn lead with the Residential Tenancies Board (RTB) as required by the Residential Tenancies Acts 2004–2022. RTB registration is your responsibility, not ours.
- You will not list the same property more than once, will not list properties you cannot legally let, and will not list short-term lets where prohibited (e.g. by planning rules in Rent Pressure Zones).
- You will update or remove your listing promptly when any material fact changes.
5. Equal Status Acts and Non-Discrimination
This section is fundamental. Breach is grounds for immediate account termination.
You must comply with the Equal Status Acts 2000–2018 when using MoveIn. You must not discriminate against, refuse to deal with, or treat any user less favourably than another on any of the following protected grounds:
- Gender
- Civil status
- Family status
- Sexual orientation
- Religion
- Age (subject to limited age-restricted accommodation exceptions)
- Disability
- Race, colour, nationality, or ethnic or national origin
- Membership of the Traveller community
- Receipt of rent supplement, the Housing Assistance Payment (HAP), or any other social welfare payment (the "housing-assistance ground")
In particular, listings, inquiry replies, and messages must not state, imply, or have the effect that HAP, rent supplement, or other social welfare recipients are unwelcome (for example, "no HAP", "working professionals only" used as a proxy, or unilateral refusal once HAP status is disclosed). Refusing a Renter on the housing-assistance ground alone is unlawful.
MoveIn will remove listings and messages containing discriminatory language and may permanently terminate accounts that breach this section. We may also pass evidence to the Workplace Relations Commission or other competent authorities where required by law.
6. User Conduct
You must not:
- Submit false, misleading, fraudulent, or scam listings or messages.
- Use MoveIn to engage in or arrange anything illegal, including unauthorised sub-letting, fraud, or money laundering.
- Demand deposits, fees, or payments off-platform before a viewing has taken place; ask for payment by wire transfer, cryptocurrency, gift card, or other irreversible methods; or pressure a Renter to send money before they have inspected the property.
- Harass, threaten, defame, or abuse other users; use slurs; or send sexually explicit, hateful, or violent content.
- Scrape, crawl, mirror, copy, frame, or otherwise access the Service except as permitted by our robots.txt or under a written agreement with us.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Upload viruses, malware, or any code intended to disrupt, impair, or gain unauthorised access to the Service or other users' devices.
- Misuse the inquiry, messaging, alert, or flagging systems, including by sending unsolicited commercial messages or lodging vexatious flags.
- Use any automated system, bot, or AI agent to create accounts, submit listings, or send inquiries at scale without our express written consent.
- Use MoveIn data or contact information for any purpose other than the bona fide arrangement of a tenancy through the Service.
7. Pricing and Fees
Use of MoveIn is currently free of charge for both Renters and Landlords. Free listings will remain available indefinitely; we have no plans to change this without notice.
We reserve the right to introduce optional paid features (for example, listing boosts, agent subscriptions, or identity-verification add-ons) and to set fees for those features. If we ever decide to charge for previously-free functionality, we will give all affected users at least 30 days' advance notice by email and via a notice on the Service, and you will have the opportunity to close your account before any charges apply. Continued use after the effective date constitutes acceptance.
Any paid features, when introduced, will be subject to supplemental commercial terms presented to you at the point of purchase.
8. User Content and Licence
You retain ownership of any text, photographs, descriptions, messages, or other material you upload to MoveIn ("User Content"). However, by uploading User Content you grant Noveternum Limited a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, modify (solely for technical formatting, watermarking, and resizing), publish, publicly display, and distribute that User Content for the purposes of:
- Operating, providing, and improving the Service.
- Displaying your listing or content to other users of the Service.
- Promoting MoveIn — for example, in marketing materials, screenshots, press, and social media — where the User Content has been published publicly on the Service. We will not use identifiable photographs of private spaces for marketing purposes without the Landlord's prior consent.
The licence in this section continues for the period your content is published on the Service and for a reasonable period thereafter for archival, audit, fraud-prevention, and dispute-resolution purposes.
You warrant that you own or have all necessary rights in the User Content you upload, and that the User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights. You are solely responsible for User Content you submit.
9. Suspension, Removal, and Termination
We may, at our sole discretion and with or without prior notice, suspend or terminate your account, remove or restrict access to any listing, message, or other content, and revoke any features previously available to you, if we have a reasonable belief that:
- You have breached these Terms or our Privacy Policy.
- Your activity is fraudulent, abusive, deceptive, scam-related, or otherwise unlawful.
- A listing is materially inaccurate, duplicates an existing listing, or relates to a property you are not entitled to let.
- Your activity exposes other users, MoveIn, or third parties to a security risk or to material risk of harm.
- You are the subject of a credible complaint, regulatory notice, or court order requiring action.
- You have used MoveIn in a way that, in our reasonable judgement, damages the integrity of the marketplace or our ability to operate it.
Where we suspect fraud, scam, or risk of harm to other users, we may act immediately and without prior notice. We will provide reasons for our decision after the fact where it is lawful and practicable to do so.
You may appeal a suspension, content removal, or termination via our contact form. We will respond to good-faith appeals within a reasonable period. Without prejudice to your statutory rights, our decision following appeal will be final.
You may close your own account at any time from your profile settings. Closure is processed as described in our Privacy Policy.
10. Notice and Action (Illegal or Harmful Content)
In accordance with Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065), we operate a notice-and-action mechanism that any user can use to report content they believe is illegal or in breach of these Terms. You can submit a notice by:
- Using the "Flag listing" option on a property page (the fastest route — your report is queued for review).
- Submitting our contact form with the URL, a description of the issue, and any supporting evidence (screenshots and PDFs are accepted).
We will review notices in a timely, diligent, and non-arbitrary manner and will inform the notifier and, where appropriate, the user whose content is affected, of the outcome.
Knowingly submitting false, manifestly unfounded, or vexatious notices is a breach of these Terms and may result in account suspension.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no representations, warranties, or conditions of any kind — express or implied — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In particular, we do not warrant that:
- Listings are accurate, complete, lawful, or that the advertised property exists, is available, or will be let on the advertised terms.
- Any Landlord, Renter, or other user is who they claim to be, creditworthy, suitable, or trustworthy, beyond the targeted checks described elsewhere in these Terms.
- The Price Score, map data, alerts, or other features will be accurate, current, or uninterrupted. The Price Score is informational and is not a valuation, an appraisal, or a recommendation to enter into any tenancy.
- The Service will operate continuously, securely, or free of bugs, viruses, or other harmful components.
You are responsible for inspecting any property, verifying any representations, and taking independent legal, financial, and other professional advice before entering into a tenancy. None of MoveIn's features, including the Price Score, replace that responsibility.
12. Limitation of Liability
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under Irish law. In particular, nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation by us.
- Any breach of statutory rights you may have as a consumer under Irish law that cannot be excluded.
- Any other liability that, under Irish law, cannot be lawfully excluded or limited.
Subject to the paragraph above and to the maximum extent permitted by law:
- We are not liable for any acts, omissions, statements, or conduct of other users — including but not limited to inaccurate listings, scam attempts, failure to attend viewings, refusal to let, tenancy disputes, deposit disputes, or damage to property.
- We are not liable for any loss of profits, loss of business, loss of goodwill, loss of anticipated savings, loss or corruption of data, or any indirect, special, incidental, punitive, or consequential damages, whether arising in contract, tort (including negligence), statute, or otherwise.
- Our total aggregate liability to you arising out of or in connection with the Service in any twelve-month period is limited to the greater of (a) the fees you paid us in that period and (b) €100.
13. Indemnity
You agree to indemnify, defend, and hold harmless Noveternum Limited, its directors, officers, employees, and contractors from and against any claims, demands, losses, liabilities, fines, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your User Content; (c) your violation of any law or any third-party right (including the Equal Status Acts, the Residential Tenancies Acts, data-protection law, or intellectual-property rights); and (d) any tenancy or prospective tenancy in which you participate as a Landlord that gives rise to a claim against MoveIn. We may, at our option, conduct the defence of any such claim, and you agree to cooperate with our defence.
14. Right of Withdrawal (Consumer Rights)
Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, consumers concluding a distance contract for services normally have 14 days to withdraw without giving a reason. Because MoveIn begins to provide the Service to you immediately upon registration, you expressly request immediate provision and acknowledge that you will lose your right to withdraw once the Service has been fully performed. Where you become liable for any fee (see Section 7), the fee may be charged on a pro-rata basis for services already supplied if you exercise a remaining withdrawal right.
This section does not affect your right to close your account at any time under Section 9, nor your statutory rights as a consumer.
15. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy, which forms part of these Terms by reference. In the event of any conflict between these Terms and the Privacy Policy in respect of personal data, the Privacy Policy prevails.
16. Changes to These Terms
We may update these Terms from time to time. For material changes — for example, the introduction of fees, changes to your dispute-resolution rights, or changes to liability — we will give you at least 30 days' advance notice by email and via a notice on the Service. Non-material changes (such as clarifications and corrections) take effect when posted on this page, and we will update the "Last updated" date at the top.
If you do not accept a change, you may close your account before the change takes effect. Continuing to use the Service after the effective date constitutes acceptance.
17. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of Ireland.
You and we irrevocably agree that the courts of Ireland have exclusive jurisdiction to settle any such dispute or claim, without prejudice to any mandatory consumer-protection rights you may have under the law of the country where you are habitually resident.
18. General
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Noveternum Limited regarding the Service.
- Severability. If any provision of these Terms is held to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary, or, if that is not possible, severed; the remainder of these Terms will continue in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours (including in the context of a merger, acquisition, or reorganisation) on notice to you.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of upstream providers, natural disasters, war, civil unrest, strikes, or government action.
- Communications. We will contact you using the email address associated with your account. Notices we send to that address are deemed received 24 hours after sending unless we receive a bounce or non-delivery report.
- No partnership. Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between you and Noveternum Limited.
- Language. These Terms are in English. Any translation is provided for convenience only; the English version prevails.
